In short: Gate Ready: SWMS for Tradies is a drafting tool. It doesn't certify, guarantee or verify compliance. You're responsible for every SWMS you prepare.
1. About these terms
Gate Ready: SWMS for Tradies (the app) and this website are provided by Vision and Beyond Pty Ltd (we, us). By using them you agree to these terms. The App Store and Google Play terms also apply to your download and subscription. Sections 2 to 9 use the same wording as the terms and notice shown in the app (version 1).
2. Before you start: the notice shown when you first open the app
Gate Ready helps you draft Safe Work Method Statements and collect worker sign-off. It is not a compliance service, and it does not certify, guarantee or verify that any SWMS prepared with it meets your obligations under the Work Health and Safety (or Occupational Health and Safety) Act, Regulations or any Code of Practice in your state or territory.
Gate Ready does not store, back up or keep copies of signed SWMS. When you export a SWMS, the exported copy is your record.
You (or your business) remain solely responsible for:
- ensuring each SWMS is accurate, complete and specific to the actual site, task and hazards
- consulting the workers who will do the work, as required by law
- ensuring the control measures are adequate and are implemented, monitored and reviewed
- deciding whether a SWMS is required for a task
- saving, distributing and keeping each signed SWMS, including giving it to the principal contractor before work starts and keeping it for at least 2 years if a notifiable incident occurs

3. What the app does
The app helps you draft a Safe Work Method Statement (SWMS) and collect worker sign-off. It's a drafting tool, not a compliance service.
4. No warranty of compliance
Gate Ready, provided by Vision and Beyond Pty Ltd, is a tool for drafting Safe Work Method Statements and collecting worker sign-off. Nothing in the app is legal, safety or compliance advice, and nothing it produces replaces a risk assessment by a competent person under applicable work health and safety laws.
5. No record keeping
The app does not store, back up or keep copies of signed or exported SWMS. Working data on your device, such as drafts, job details and settings, is kept only on that device and in any backup you have set up for it. It is not a record of any SWMS.
6. Suggested content
Suggested hazards and controls come from a standard library and your answers. They are a starting point only and may be incomplete, generic or not suited to your task or site. A competent person must review, check and change them as needed before use.
7. User responsibility
You are solely responsible for the accuracy, completeness and legal adequacy of any SWMS or related document prepared with the app; for saving, distributing and keeping signed SWMS as the law requires; and for complying with all applicable work health and safety obligations, including consulting workers.
8. Limitation of liability
To the maximum extent permitted by law, Vision and Beyond Pty Ltd excludes all liability for any loss, damage, injury or claim arising from or connected with reliance on content prepared with the app, except where that liability cannot be excluded under the Australian Consumer Law or other applicable law.
9. Consumer law
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where liability cannot be excluded but can be limited, our liability is limited, at our option, to supplying the service again or paying the cost of having it supplied again.
10. Subscriptions
Your first SWMS is free. After that there's a one-month free trial, then Gate Ready is $24.99 per month, including GST. Subscriptions are billed, managed, cancelled and refunded through the App Store or Google Play under their terms. If a subscription lapses, you can't start new SWMS, but your existing SWMS still open, sign and export.
11. Rules and updates
We may change the rules the app uses. Rule changes arrive as app updates. The app may require you to install an update before you continue, and you should keep it up to date. Every SWMS shows the version of the app and the rules it was prepared with.
12. This website
This website gives general information about the app. It isn't legal, safety or compliance advice.
13. Governing law
These terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales.
14. Changes to these terms
We may update these terms. The date at the top shows when they last changed. If the wording in the app changes, the app asks you to accept it again.
